RMB Watercraft & Performance – Pre-Purchase Inspection Report
These Terms & Conditions apply to all pre-purchase inspections carried out by RMB Watercraft & Performance (“RMB”, “we”, “us”, “our”).
1. Nature and Scope of Inspection
1.1 The inspection is a non-invasive visual and operational assessment only, conducted at the location and under the conditions present at the time of inspection.
1.2 The inspection does not include dismantling, disassembly, internal engine inspection, compression or leak-down testing (unless specifically requested and recorded), or specialist diagnostic strip-down procedures.
1.3 The inspection is limited to components that are reasonably accessible without removal of parts.
2. Point-in-Time Assessment
2.1 This report reflects the observable condition of the personal watercraft (PWC) and trailer at the date and time of inspection only.
2.2 RMB accepts no responsibility for deterioration, misuse, modification, transport damage, storage conditions, or mechanical failure occurring after the inspection.
3. No Warranty or Guarantee
3.1 This inspection report is not a warranty, insurance policy, or guarantee of future performance, reliability, durability, or suitability for purpose.
3.2 Except as required by law, no express or implied warranties are given in relation to the vessel, engine, jet unit, trailer, or associated components.
4. Latent and Hidden Defects
4.1 RMB is not liable for defects that are:
- Hidden, internal, or latent;
- Intermittent in nature;
- Not reasonably detectable without dismantling or specialist testing; or
- Not present or evident at the time of inspection.
4.2 Internal engine condition, gearbox condition (where applicable), crankshaft bearings, internal corrosion, and similar components cannot be guaranteed without strip-down inspection.
5. Water Testing Limitations
5.1 If a water test is not performed, performance under load, cooling efficiency, cavitation, vibration, steering characteristics, and high-RPM operation cannot be fully assessed.
5.2 If a water test is performed, it reflects performance only under the conditions on that day and does not guarantee future operational reliability.
6. Electronic and ECU Systems
6.1 Fault codes may not be stored at the time of inspection.
6.2 Intermittent electrical faults, sensor failures, wiring corrosion, or ECU-related issues may not be detectable during inspection.
7. Repair Estimates
7.1 Any repair estimates provided are indicative only and subject to:
- Further disassembly,
- Parts availability,
- Supplier pricing changes,
- Discovery of additional faults.
7.2 Estimates are not fixed quotations unless separately provided in writing.
8. Consumer Guarantees Act 1993 (NZ)
8.1 If the client is acquiring this inspection service for personal, domestic, or household use, the Consumer Guarantees Act 1993 (“CGA”) may apply.
8.2 Nothing in these Terms is intended to contract out of the CGA where it applies.
8.3 If the client is acquiring this service for business purposes, then pursuant to section 43 of the CGA, the parties agree that the CGA shall not apply.
9. Fair Trading Act 1986
9.1 RMB will provide the inspection service with reasonable care and skill and will not engage in misleading or deceptive conduct.
9.2 The client acknowledges that this report is an opinion based on observations made at the time and is not a representation that the vessel is free from all defects.
10. Limitation of Liability
10.1 To the maximum extent permitted by law, RMB’s total liability arising from this inspection, whether in contract, tort (including negligence), equity, or otherwise, is limited to the amount paid by the client for the inspection service.
10.2 RMB shall not be liable for:
- Consequential loss,
- Loss of profits,
- Loss of use,
- Transport or recovery costs,
- Financing costs,
- Loss arising from purchase decisions.
11. Third-Party Reliance
11.1 This report is prepared solely for the named client.
11.2 No third party may rely on this report without prior written consent from RMB Watercraft & Performance.
12. Client Acknowledgement
The client acknowledges that:
- They understand the limited and non-invasive nature of this inspection.
- The report is a point-in-time assessment only.
- No warranty of future reliability has been given.
- They remain responsible for conducting their own due diligence, including finance owing checks and ownership verification.
